This GDPR Statement concerns Employ Intelligence, Inc. and it’s software platform, including TalentEi applications (referred to collectively here as “EI”), and applies only to data subjects located in the European Union (EU), European Economic Area (EEA), and Switzerland, and supplements our broader Privacy Policy located here

Where EI processes your personal data as the controller, you may contact us directly regarding any privacy concerns or rights under the GDPR.
Controller and Processor Roles and Relationships
EI may act as a data processor, data controller, or both, depending on the circumstances:
- As Processor: When your data is collected by us to facilitate an employment application process for our clients (the employer to whom you are applying) we are typically acting as a processor.
- As Controller: In certain circumstances, you may apply with us directly to be considered for employment across a variety of employers. In this case we are the controller of your personal information.
- When your data is provided to us by a third party (e.g., a recruiter referring you as a candidate), we may be acting as a processor on behalf of that party until you directly engage with us, after which time, either us or the employer is the controller of your personal information.
If we receive a request in our capacity as a processor, we will either forward your request to the appropriate controller or advise you on how to contact them directly. In any case, you may always contact us to clarify these roles and relationships with respect to your personal data.
Lawful Basis for Processing Personal Data
We process personal data under one or more of the following legal bases under Article 6 of the GDPR:
- Consent – e.g., when you voluntarily provide data for job matching purposes. You may withdraw your consent at any time.
- Contractual Necessity – e.g., when processing is necessary for the performance of a contract with you.
- Legal Obligation – e.g., to comply with applicable laws or regulatory requirements.
- Legitimate Interests – e.g., to improve our services, unless overridden by your rights.
- Vital Interests – e.g., when processing is required to protect someone’s life.
- Public Task – Not typically applicable to E.
If we rely on legitimate interests, we will ensure these are balanced against your data protection rights and interests.
Data Retention
When acting as a processor, we retain your data at the direction of the controller, and in accordance with their data retention policy. When acting as controller, we retain your personal data only as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law. Specific retention periods depend on the nature of the data and the context in which it was collected and are available upon request.
International Transfers of Personal Data
EI is based in the United States. Your personal data may be transferred to, and processed in, countries outside of your country of residence, including the U.S. These countries may have different or less protective data protection laws.
To safeguard your data:
- We rely on Standard Contractual Clauses (SCCs) approved by the European Commission in our Data Processing Agreements.
- When available, we also rely on adequacy decisions or Binding Corporate Rules.
- Explicit consent will be obtained where no other legal safeguards apply.
We may share your personal data with our affiliates, service providers, legal authorities (when required), and other 3rd parties as necessary for the purposes outlined. Our list of processors and their jurisdictions is available here:

Security Measures and Impact Assessments
We implement appropriate technical and organizational security measures to protect your personal data against loss, misuse, unauthorized access, or disclosure. Additional information about specific security measures may be found here
Where required, we conduct Data Protection Impact Assessments (DPIAs) to evaluate risks of certain processing activities.
Children’s Data
Our services are not intended for individuals under the age of 16, and we do not knowingly collect personal data from children without verifiable parental consent. If you are the parent or legal guardian of a minor and believer that we have collected personal information your child in error, please contact us immediately at privacy@teamei.com
Automated Decision-Making and Profiling
We do not use automated decision-making, including profiling, that produces legal or similarly significant effects concerning you.
If this changes, we will provide you with meaningful information about the logic involved and the significance of the decision-making.
Your Data Protection Rights (EU/EEA & Switzerland)
Under the GDPR, and subject to limitations, you have the following rights:
- Right to Access – You may request a copy of the personal data we hold about you.
- Right to Rectification – You may request corrections to inaccurate or incomplete personal data.
- Right to Erasure (“Right to be Forgotten”) – You may request deletion of your data under certain conditions.
- Right to Restriction – You may request restriction of processing in specific scenarios (e.g., if accuracy is contested).
- Right to Data Portability – You may request transfer of your data to another provider in a structured, commonly used format.
- Right to Object – You may object to processing based on our legitimate interests or for direct marketing purposes.
- Right to Withdraw Consent – If processing is based on consent, you may withdraw that consent at any time.
- Right to Lodge a Complaint – You may contact a supervisory authority if you believe we have violated your rights.
- Rights Related to Automated Decision-Making – You have the right to not be subject to any decision that are solely based on automated processing if the decision significantly affects you. This includes profiling.

Exercising Your Rights Under GDPR
When EI is acting as a processor, you must exercise your rights through the applicable data controller.
